By accessing and using VacationMonitor ("Service", "we", "us", "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. License to Use

We grant you a limited, non-exclusive, non-transferable license to use VacationMonitor for your personal, non-commercial vacation price monitoring needs, subject to the terms of this agreement. You may not:

• Modify or alter the Service, documentation, or any part thereof
• Reverse engineer, decompile, or disassemble the Service
• Scrape, crawl, or mass-download data from the Service
• Use the Service for commercial purposes without explicit written permission
• Sublicense, rent, lease, or transfer the Service to others
• Access or use the Service via automated means (bots, scrapers, scripts) except for authorized integrations

3. Service Description

VacationMonitor is a price monitoring platform that:

• Allows you to save Booking.com vacation searches
• Automatically monitors hotel prices over time
• Displays price history and trends in a visual dashboard
• Provides AI-powered insights and booking recommendations
• Exports price data and reports in CSV format

The Service does not directly book hotels, modify reservations, or interact with your Booking.com account. All bookings remain your sole responsibility.

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes and in accordance with this agreement
• Maintain the confidentiality of your account credentials
• Be responsible for all activities under your account
• Immediately notify us of any unauthorized account access
• Not submit URLs or data from Booking.com obtained through illegal means or in violation of Booking.com's terms
• Not use the Service to circumvent Booking.com's terms of service or security measures

5. Acceptable Use Policy

You agree not to:

• Violate any applicable laws or regulations
• Harass, threaten, or harm others
• Submit spam, malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or data
• Impersonate any person or entity
• Sell, trade, or redistribute access to the Service
• Use the Service in any way that infringes third-party intellectual property rights

Violations of this policy may result in immediate account suspension or termination without refund.

6. Intellectual Property Rights

Our Content: The Service, including its design, code, features, and documentation, is owned by VacationMonitor or our licensors. All intellectual property rights are reserved. You may not use, copy, or reproduce any of our content without explicit written permission.

Your Content: You retain ownership of your searches, notes, and data you upload. By using the Service, you grant us a non-exclusive license to use, process, and display your data for the purpose of providing the Service.

Booking.com Data: URLs, hotel names, prices, and other data from Booking.com remain the property of Booking.com. We collect this data solely for your personal price monitoring and do not claim ownership over it.

7. Disclaimer of Warranties

The Service is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind. We disclaim all implied warranties, including:

• Merchantability or fitness for a particular purpose
• Non-infringement or accuracy of information
• Uninterrupted or secure access

We do not guarantee:

• Real-time price accuracy (prices are updated on a scheduled basis)
• Uptime or availability of the Service
• That the Service will meet your specific needs
• That price monitoring will result in better booking decisions

Price data is provided for informational purposes only and does not constitute financial advice.

8. Limitation of Liability

To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for lost profits, lost data, lost business opportunities, or cost of substitute services
• Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is less

This applies even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless VacationMonitor and its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Violation of these Terms of Service
• Violation of any applicable laws or third-party rights

10. Account Termination

Termination by You: You may delete your account at any time via the Settings page. Upon deletion, your personal data will be removed within 30 days, though aggregated analytics may be retained.

Termination by Us: We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in illegal activity or abuse
• Exceed reasonable usage limits
• Pose a security or operational risk

Upon termination, your right to use the Service ceases immediately. We retain the right to archive your data as required by law.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time. We will provide reasonable notice of material changes when possible. Your continued use of the Service following such changes constitutes your acceptance of new terms.

In the event of Service discontinuation, we will provide all users with notice and a reasonable opportunity to export their data (minimum 30 days).
